I love UPS. Sure, they've done some odd things (http://developers.slashdot.org/article.pl?sid=05/06/07/0254246 for example) but the Postal Service likes to bend things that shouldn't be bent (some magazines I've bought, for example)...I dunno, they're just more endearing to me, that Brown crew.

I heard this years ago from Lazlow Jones (GTA Radio Station VA) on his underground railroad website. He talked about a copyright violation for someone putting the song "Happy Birthday" on a website without asking the company who owned it permission.

Please note, there is a difference between a "trademark" and a "copyright". A trademark means that no one in the same TRADE can use that symbol/etc. for marketing. If fedex wanted to start using brown everything and calling themselves brown UPS could sue. This puts no restrictions on companies in any other trade. (i.e. the Cleveland Browns, etc.). 1'd for stupidity...

In 1998, UPS registered two trademarks on the color brown. The trademarks prevent other delivery companies from using the color for vehicles or clothing, or any other company if it creates market confusion with UPS.

2 because you really, really tried, but trademark and copyright are completely different, and it actually makes sense that UPS can prevent other package delivery companies from using the color (and nickname) brown, because people could then get confused and think they were getting UPS quality service from some Joe Schmo driving around in the same color brown truck....
